1. About these terms

These terms govern your use of AvaSettle.com, including the swap service, the crypto payment gateway, the merchant dashboard, the API and the plugins (together, the "Services"). "AvaSettle", "we" and "us" mean the operator of AvaSettle.com. By using the Services you agree to these terms. If you do not agree, do not use the Services.

2. Who may use the Services

  • You must be at least 18 years old and able to enter a binding agreement.
  • You may not use the Services if you are subject to sanctions, or if using them is prohibited by the laws that apply to you. You are responsible for knowing and following those laws.
  • The Services may not be available in every country. We may limit or block access from some locations.
  • You may not use the Services for money laundering, terrorist financing, fraud, scams, ransomware, darknet markets, the sale of illegal goods or services, or to move funds from theft or hacks.

3. Swaps

  • A swap exchanges one cryptocurrency for another and sends the result to the address you give. No account is needed.
  • Rates float: the amount you receive is based on the market rate when your deposit is received, minus network fees and the service fee shown before you confirm. The estimate is not a guarantee.
  • Each pair has a minimum and a maximum. Deposits outside these limits, or deposits that cannot be exchanged, are returned to your refund address, minus network fees.
  • You must send only the coin and network shown, to the deposit address shown, with the memo or tag if one is shown. Coins sent on another network, without a required memo, or after a deposit address has expired may not be recoverable.
  • You are responsible for the receiving and refund addresses you give. Transfers on a blockchain cannot be reversed, and we cannot recover coins sent to a wrong address.
  • Swaps are executed through liquidity sources selected by AvaSettle. AvaSettle does not keep your coins in an account at any point.
  • No account and no identity documents are required for a normal swap. We and our liquidity sources screen transactions against public risk data. A transaction linked to illegal activity, sanctions or stolen funds may be delayed, refused, refunded or held while it is reviewed, and in that case we may ask for information about the source of the funds.

4. Merchant accounts and the payment gateway

  • A merchant account requires a confirmed e-mail address and our approval. We may refuse or close an account without giving a reason.
  • You must give accurate information about yourself and your business, and keep your password, authenticator and API keys secure. Actions taken with your credentials are your responsibility.
  • Payments made by your customers are converted to USDT and credited to your balance in USDT on BNB Smart Chain (BEP20). Conversion runs at the market rate of the route used at the time; the credited amount is shown for each payment in your dashboard.
  • The gateway fee is a percentage of each confirmed payment, shown in your account. Withdrawals carry the network fee shown before you confirm. We may change fees with 14 days' notice by e-mail.
  • Withdrawals go only to payout wallets you have added. A new payout wallet becomes usable 48 hours after it is added.
  • You are responsible for your products and services, for your relationship with your customers, for refunds to them, and for your taxes and legal obligations.
  • You may not use the gateway for the activities listed in section 2, for adult content involving minors, for weapons, for unlicensed financial services or gambling, or for any business that is illegal where you or your customers are.
  • We may suspend an account, hold funds or refuse a withdrawal when we reasonably suspect a breach of these terms or a legal obligation requires it.

5. Risks

  • Cryptocurrency prices can change quickly. A payment or swap may be worth more or less when it is completed than when it was started.
  • Blockchains can be congested or interrupted. Confirmations, conversions and withdrawals may take longer than usual.
  • Third-party networks, wallets, nodes and liquidity sources can fail. We are not responsible for losses caused by them, or by errors in addresses, networks or memos you provide.
  • Nothing on AvaSettle.com is investment, tax or legal advice.

6. Fees

The swap service fee (0.5% at the time of writing) is included in the rate shown before you confirm a swap. Gateway fees for merchants are shown in the merchant account. Network fees are paid to the blockchain, not to AvaSettle.

7. Your use of the Services

  • Do not interfere with the Services, test their security without written permission, or access them by automated means beyond the published API and its rate limits.
  • The plugins may be used and modified to connect your own sites to AvaSettle.com.

8. Liability

The Services are provided "as is". To the extent the law allows, AvaSettle is not liable for indirect or consequential losses, lost profits or lost data, and our total liability for any claim is limited to the fees you paid to AvaSettle in the 3 months before the claim. Nothing in these terms limits liability that cannot be limited by law.

9. Changes and termination

We may change these terms. The date at the top shows the latest version, and continued use means you accept it. You may stop using the Services at any time; merchants can withdraw their balance subject to section 4.
